Terms and Conditions for Remote Online Notarization
Effective Date: May 18, 2026
Welcome to My Case Coordinator ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website, https://www.mycasecoordinator.online (the "Site"), and our Remote Online Notarization (RON) services (the "Services").
By scheduling an appointment, uploading documents, or participating in a notarization session, you ("User," "Client," or "Signer") agree to be bound by these Terms. If you do not agree, you may not use our Services.
1. Scope of Services
Company provides electronic notary public services via live, two-way audio-video communication technology in accordance with the laws of the State of Texas.
A notary public is an impartial witness and cannot provide legal advice, draft legal documents, or advise you on the legal effects of any document. For legal guidance, please consult a qualified attorney.
2. Eligibility & Technical Requirements
To successfully complete a Remote Online Notarization session, you must meet the following mandatory requirements:

Age & Capacity: You must be at least 18 years of age, of sound mind, and participating of your own free will.

Technology: You must have a smartphone, tablet, or computer equipped with a high-definition web camera, microphone, secure internet connection, and an updated web browser.

Environment: You must be in a quiet, private, well-lit room free from background noise, distractions, or unauthorized third parties.

Language: The session must be conducted in English unless an authorized translator or interpreter arrangement is approved by us prior to the session, subject to applicable state laws.
3. Identity Verification & Knowledge-Based Authentication (KBA)
State laws mandate strict identity proofing protocols before a notary can execute a digital seal.

Credential Analysis: You must upload a valid, unexpired government-issued photo ID (e.g., U.S. Driver's License or Passport). The ID will undergo automated cryptographic and biometric authentication.

Knowledge-Based Authentication (KBA): If required by state law, you must successfully pass an online verification quiz containing questions generated from your public credit history. You will have a limited timeframe and a limited number of attempts to pass.

Verification Failures: If you fail KBA or Credential Analysis, the platform will automatically lock the session. We are legally prohibited from proceeding with the notarization if your identity cannot be verified.
4. Consent to Recording & Data Storage
By entering into a RON session, you grant your explicit consent to the following:

Audio-Video Recording: The entire live video session will be securely recorded, uninterrupted, from start to finish.

Mandatory Retention: You acknowledge that we are legally required by state statute to retain this audio-video recording and our electronic notary journal for a mandatory period of [e.g., 5 to 10] years. This data retention overrides standard consumer data-deletion or "right to be forgotten" requests.
5. Fees, Cancellations, and No-Refund Policy

Notary Fees: Fees are charged per notarial act (seal) plus a flat platform/convenience fee, as detailed during the checkout process.

Strict No-Refunds: All fees are non-refundable once payment is processed.

Verification Failure Forfeiture: If a session cannot be completed because you fail the KBA quiz, provide an invalid/expired ID, experience structural technical failures on your device, or arrive more than [10/15] minutes late, your payment will be forfeited, and no refund will be issued.
6. Document Content and Legality

User Responsibility: You are solely responsible for the content, accuracy, completeness, and legal compliance of the documents you upload.

Right to Refuse Service: A notary reserves the right to refuse service at any time if they suspect fraud, coercion, duress, illegal activity, or if the signer appears confused, impaired, or lacking the requisite legal capacity.
7. Limitation of Liability
To the maximum extent permitted by applicable law, My Case Coordinator and its individual commissioned notaries shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, loss of profits, data, or use arising from a third-party's refusal to accept a legally executed remote online notarization, or technical downtime of third-party RON platforms. Our total liability for any claim shall not exceed the total amount paid by you for the specific service transaction.
8. Governing Law and Jurisdiction
These Terms and any disputes arising out of or related to our Services shall be governed by, construed, and enforced in accordance with the laws of the State of [State of Commission], without regard to conflict of law principles.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Any updates will be posted directly to this page with a revised "Effective Date." Continued use of our Services after changes are posted constitutes your acceptance of the updated Terms.
